Resolution of Support

TITLE: IN OPPOSITION TO THE EMPLOYEE FREE CHOICE ACT

SUBMITTED BY: ARKANSANS FOR THE SECRET BALLOT

WHEREAS, the National Labor Relations Board (NLRB) is an independent agency of the United States government created in 1935 to administer the National Labor Relations Act (NLRA); and,

WHEREAS, NLRA was meant to curtail work stoppages, strikes and general labor strife, harmful to the U.S. economy and the nation’s general well-being; and,

WHEREAS, NLRB is charged with conducting elections for labor union representation and remedying unfair labor practices; and,

WHEREAS, NLRB currently will certify a union as the exclusive representative of employees if it is elected by a majority signature drive, the card check process, or a secret ballot NLRB election, which is held by 30% or more of employees in a bargaining unit sign statements asking for representation by a union; and,

WHEREAS, the proposed Employee Free Choice Act (EFCA) would cancel an employer’s right to demand a secret ballot election when a majority of employees have signed union cards; and,

WHEREAS, NLRB records and testimony before Congress provide many examples where the card-check process has been challenged on the basis of union misrepresentation, forgery, fraud, peer pressure, threats of intimidation and deportation, and loss of 401(k), health and other promised benefits; and,

WHEREAS, Eighty-nine percent of the American public support federally-supervised, secret ballot elections to decide whether to form a union (McLaughlin & Associates poll)

WHEREAS, The U.S. Supreme Court called the card-check process “inferior to the [secret ballot] election process”; and,

WHEREAS, Small business owners, corporations and industry trade associations, and union officials; and,

WHEREAS, People from across the political spectrum oppose the Employee Free Choice Act; therefore be it

RESOLVED, that Arkansans for the Secret Ballot strongly opposes Congressional passage of the Employee Free Choice Act; and be it

RESOLVED, that Arkansans for the Secret Ballot encourages its members to oppose the Employee Free Choice Act; and finally be it

RESOLVED, that Arkansans for the Secret Ballot urges its members to contact their elected federal officials requesting their opposition to the Employee Free Choice Act.
